Certificate of Pension issued 17th day of March 1856 and sent to J G Austin P-----. Recorded on Roll of Pensioners under act Feb 2, 1848, page 315, vol 3 (or 13) Declaration: In order to obtain the benefit of the acts of Congress passed 7 July 1838 and 3 march 1843 granting half pay and pensions to certain widows. State of TN, Greene CO: On this 27 day of Sept 1845 personally appeared before me the suscriber a justice of the peace for the said county, Mrs Elinder Wills, a resident of the county and state aforesaid, aged 79 years past who first being duly sworn according to law, doth on her oath make the following declaration in order to obtain the benefit of the act of congress passed the 7 of July 1838 and the 3rd of March 1843 granting pay and pensions to ceertain widows, to wit: That she is the widow of Lewis Wills who was a soldier in the war of the revolution and drew a pension of $96 per annum on account of his service in said war. For the particulars of his service she refers the Department to his declaration and papers now on file in the office of the commissioner of pensions. She further declars that she was married to the said Lewis Wills in the County of Nash in the state of NC on the 15 OCt 1792 but that she has no record or documentary evicence to establish the fact nor has she any record of the ages of her children. That her husband the aforesaid Lewis Wills died in the county of Greene in the state of Tennessee on the fifth day of March o832, that she was not married to him 0prior to his leaving the service but the marriage took place previous to the 1st Jan 1794, viz: at the time before mentioned and she is still a widow. Elinder X Wills (her mark) Attest: William Houston, John Hutchison Sworn to and inscribed on the day and year before written before me a justice of the peace in and for said county and I further certify that the said Mrs Elinder Wills is unable to attend court on account of bodily infirmity and the distance to Green Court, thence it being about 15 miles. On this 27th day of September 1845 personally appeared before the subscriber a justice of the peace for said county, Mary Brumfield, a resident of the county and state aforesaid aged 76 years who first being duly sworn according to law doth on her oath make the following affidative relative to the marriage of elinder Wills widow of Lewis Wills late a RW pensioner of the US who died in 1832, to wit: That she is well acquainted with the aforesaid Elinder Wills widow of the aforesaid Lewis , that she knew the said Lewis and Elinder before and after they were married, and that they lived together and husband and wife until he the said Lewis died in 1832 in the county of Greene, state of Tn, that she was at the wedding of the aforesaid Lewis and Elinder Wills and saw them joined together as husband and wife by the Rev James Mortin in the county of Nash in the state of NC on or about the 15th day of October 1792, she further states that she is so certain as to the State of Tn, Co of Greene..Be it known that a County Court held in and for said county on the 30 day of March 1856. It was proven to the satisfaction of said court by the testimony of William Rollins and William Housten residents of said county and whose affidavits are hereto annexed and who are credible persons that Lewis Wills, an old Revolutionary Soldier decd in the aforesaid county on or about the 5th day of March 1832 leaving Elinder Wills his widow and that the said Elinder wills also died in the said county of Greene afforesaid on the 22 day of April 1853 leaving the following named children who are now the only surviving children of the said Lewis and Elinder Wills dec viz Jacob Wills, Robert Wills, Sophia Wills, Elender Wills and Martha Wills. All of whom are above the age of twenty one years and are residents of the above named county of Greene and State aforesaid. and that the said Elender Wills at the time of her death aforesaid was a pensioner of the United States under the act of 2 Feb 1848 and further that Jacob Wills, one of the above named children and whose deposition is hereto annexed has been appointed administrator of the Estate of the Said Elender Wills (?) is duly authorized by the laws of this state to act as such administrator and his administratiors bond filed in the proper office is in the sum of $700 . Jacob Wills a resident of the county of Greene and state aforesaid aged about 49 years being duly sworn according to the law declaring that he is the son of Lewis Wills and Elender Wills mentioned in the annexed certificate of court, and also the duly appointed administrator of the estate of his mother the above named Elender Wills that his father the above named Lewis Wills, died in the county of Greene aforesaid on or about the 5th day of March 1832 and that at his death he was a Revolutionary Pensioner under the act of March 1818 and that his death he left his above named mother a widow who also died in the County of Greene aforesaid on the 22 day of April 1853 and that at the time of his death she was also a revolutionary pensioner of the United States under the act of 2 Feb 1848 at the rate of $60 per annum and that the following named children are now the only surviving children of his said father and mother above named all of whom are above the age of twenty one years and reside in the county of Greene aforesaid. viz: Jacob Wills, the deponent and administrator as above and Robert Wills, Sophia Wills, Elender Wills and Martha Wills. That he Makes this declaration for the purpose of obtaining such arrears of pension as may be found due the said Elender wills by virtue of the act of July 1848 and the certificate (----) to his said mother aforesaid is hereby surrendered On behalf of himself and his brother and sister he claims pension under the various acts (under which his said mother was pensioned) at the rate of $96 per annum in lieu of the amount alloted her and he refers to such papers in file as may be for proof of the death and service of his said father as well as the marriage & c of his said mother.
